Terms of Service

These Terms of Service (“Terms”) govern your use of the SmartWords mobile application (the “App”), operated by Infinatec Solutions LLC (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Subscriptions

Some features of the App are billed on a subscription basis (“Subscription”). When you subscribe, you will be billed in advance on a recurring basis according to the billing cycle you choose at signup (monthly or annual).

SmartWords offers a 7-day free trial for new subscribers. At the end of the free trial, your subscription will automatically convert to a paid subscription according to the plan you selected, unless you cancel before the trial ends.

Subscriptions automatically renew at the end of each billing cycle under the same terms unless cancelled. You may cancel your subscription at any time through your Apple ID account settings on your iOS device (Settings → your name → Subscriptions → SmartWords). Cancellations take effect at the end of the current billing cycle; you retain access to subscription features until then.

Apple’s Role

SmartWords is distributed through Apple’s App Store. Apple processes all subscription payments, manages billing, and handles refund requests according to its standard App Store policies. Apple is a third-party beneficiary of these Terms and may enforce them against you. By subscribing, you also agree to Apple’s standard End User License Agreement and the App Store Terms and Conditions.

Refunds

Subscription fees are non-refundable except where required by law. If you believe you are entitled to a refund, please request one through Apple’s standard refund process at reportaproblem.apple.com. Refund decisions are made by Apple at its discretion.

Third-Party Links

The App and our website may contain links to third-party websites or services that are not owned or controlled by Infinatec Solutions LLC. We have no control over, and assume no responsibility for, the content, privacy practices, or policies of any third-party sites. You acknowledge that we are not responsible for any damage or loss caused by your use of or reliance on third-party content. We encourage you to review the terms and privacy policies of any third-party sites you visit.

Intellectual Property

The App, including its name, logo, visual design, word definitions, gameplay mechanics, and original content, is the exclusive property of Infinatec Solutions LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the App except as permitted by these Terms or applicable law.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on devices you own or control.

Acceptable Use

You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Use automation, bots, scripts, or other means to artificially inflate scores, streaks, progress, or token balances within the App
• Attempt to gain unauthorized access to the App, its servers, or any related systems
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law

Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Infinatec Solutions LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim arising from these Terms or your use of the App will not exceed the amount you paid to us (via Apple) in the 12 months preceding the claim.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the App will be resolved in the state or federal courts located in California, except where superseded by mandatory consumer protection laws of your jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. For material changes, we will provide reasonable notice (such as a notice in the App or on our website) before the changes take effect. Your continued use of the App after changes take effect constitutes your agreement to the updated Terms.
